These Terms of Use (“Terms”) govern your access to and use of the Healthy Body Index (“HBI”) website, email waitlist, and iOS application (together, the “Services”), operated by Xpand Digital (“we”, “us”, or “our”). Please read them carefully.
1. Acceptance of terms
By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
2. Description of the service
Healthy Body Index is a food-scoring platform that rates foods across twelve dimensions of nutritional science and provides related educational content. The Services offer general nutrition information and tools to help you understand and log the foods you eat. We may add, change, or remove features at any time.
3. Health and medical disclaimer
Healthy Body Index provides general nutrition education and structure/function information about how foods and their compounds support the body’s normal, healthy function. It does not provide medical advice and is not a substitute for professional medical care.
Nothing in the Services is intended to diagnose, treat, cure, or prevent any disease or health condition. HBI scores describe nutritional quality; they are not medical, dietary, or clinical recommendations for any individual. Always seek the advice of a qualified physician, dietitian, or other healthcare professional before making changes to your diet, and never disregard professional advice or delay seeking it because of something you have read or seen in the Services.
4. Eligibility and accounts
You must be at least 13 years old to use the Services. If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly of any unauthorised use of your account.
5. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms;
- Attempt to access, scrape, or copy our data or content without authorisation;
- Interfere with, disrupt, or compromise the security or integrity of the Services;
- Reverse engineer or attempt to derive the source of our scoring system; or
- Misrepresent your affiliation with us or impersonate any person or entity.
6. Intellectual property
The Healthy Body Index scoring system, its underlying methodology, the HBI name and logo, and all content, text, graphics, and software that make up the Services are owned by Xpand Digital or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable licence to use the Services for your own personal, non-commercial purposes. All rights not expressly granted are reserved.
7. Third-party links
The Services may contain links to third-party websites, including research sources and published studies. We provide these links for reference and do not control or endorse their content. We are not responsible for third-party sites, and your use of them is at your own risk and subject to their terms.
8. Disclaimer of warranties
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any information they contain is complete or accurate for your circumstances.
9. Limitation of liability
To the fullest extent permitted by law, Xpand Digital and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or in connection with your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, to use the Services in the twelve months preceding the claim.
10. Changes to these terms
We may revise these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
11. Governing law
